By using or accessing the Redfinger APP and website Services ("Services”) in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways.

 

Remember that your use of Redfinger’s Services is at all times subject to the Terms of Use, which incorporates this Privacy Policy. If you are a resident of the European Union (“EU”), United Kingdom, Lichtenstein, Norway, or Iceland, you may have additional rights under the EU General Data Protection Regulation (the “GDPR”) with respect to your Personal Data (as defined in the GDPR). In this event, please refer to our GDPR Privacy Notice, as it applies to you too.

 

CONTENTS

This Privacy Policy covers our treatment of personally information (“Personal Information”, which refers to information that may be used to directly or indirectly identify a natural person) that we gather when you are accessing or using our Services, but not to any other practice beyond the Services. We gather various types of Personal Information from our users, as explained in more detail below, and we use this Personal Information internally in connection with our Services, including to personalize, provide, and improve our services, to allow you to set up a user account and profile, to administer your use of our Services, to contact you and allow other users to contact you, to fulfill your requests for certain products and services, and to analyze how you use the Services. In certain cases, we may also share some Personal Information with third parties, but only as described below. We will use the Personal Information in any countries or areas in which the use of the Personal Information is permitted under this Privacy Policy for the period required for the fulfillment of the purpose of the use of the Personal Information indicated in this Privacy Policy. You may choose not to provide certain Personal Information, however, you are unable to use complete function of the Services if you choose to do so.

As noted in the Terms of Use, we do not knowingly collect or solicit personal information from anyone under the age of 13. If you are under 13, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. CHANGES

We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by sending you an email, and/or by some other means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them.  If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is collected.

 

INFORMATION COLLECTION

Information You Provide to Us:

We receive and store any information you knowingly provide to us, including

through the registration process and/or through your account settings, we may collect. your email address.

While using Redfinger Services, you may provide third-party account credentials to login to third party sites (including Google, Facebook, Line) using their proprietary secure login forms. By signing in to a third party site or service through Redfinger Services, you understand your [username, profile picture, and other possible ] information in those accounts (“Third Party Account Information”) may be transmitted to us for registration, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy. Information may be required to register with us or to take advantage of some of our features.  

 

We may communicate with you if you’ve provided us the means to do so. For example, if you’ve given us your email address, we may send you promotional email about your use of the Services, or notify of new products that you might be interested based on your use of the Services. By providing the relevant communication means to us, you agree that we may, to the extent permitted by applicable law, contact you for the above mentioned purposes. Also, we may receive a confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our services. If you do not want to receive communications from us, please indicate your preference by clicking on the un-subscription or communication preferences link in the emails or communications.

 

Information Collected Automatically

Whenever you interact with our Services, we automatically receive and record information on our server logs from your browser or device. We may use this data to customize content for you that we think you might like, based on your usage patterns. We may also use it to improve the Services – for example, this data can tell us how often users use a particular feature of the Services, and we can use that knowledge to make the Services interesting to as many users as possible. Information we automatically receive may include the following:

 

Device Information: We may collect device-specific information (including your hardware model, operating system version, unique device identifiers and mobile network information). We may associate your device identifiers with your Redfinger account. We may also periodically collect technical information about your computer, system, application software and peripherals to facilitate the provision of software updates, product support and other services to you (if any) related to the our Services, and to verify compliance with these Terms and to detect fraud.

 

Log Information: When you use our Services (including any Redfinger products), we may automatically record or log technical and related information from your device, its software, and your activity using the Services. This may include:

• The device’s Internet Protocol (“IP”) address;

• Identification numbers associated with your devices (or synthetic anonymous IDs);

• Device event information such as crashes, system activity and hardware settings;

• Locale preferences (country-level only);

• Application activity such as app upload, app download, app installation, app uninstallation, app start, app play duration, app stop, app crashes, app network activity and app resource consumption;

• Date and time stamps associated with transactions;

• Purchase transaction history;

• System configuration Information;

• Metadata concerning your Android apps;

• Other interactions with the Redfinger Services and third party advertisements.

 

Cookies: We use cookies to enhance your experience on our website. Cookies are pieces of information that are stored on the hard drive of your computer and are used for record-keeping purposes. Use of cookies facilitates web surfing by performing certain functions. You may refuse to accept cookies when you are alerted to their existence by us or by activating the setting on your browser, which allows you to refuse the setting of cookies. However, if you select this setting you may be unable to access certain parts of our website.

 

The Services may use the following cookies:

• A cookie which recognizes a user’s browser type, browser language, the date and time of a user’s request and referral URL;

• A cookie which identifies the web page visited before you came to our website;

• A cookie which logs information you search for on our website.

 

Our advertising partners may also transmit cookies to your browser or device, when you click on ads that appear on the Services. Also, if you click on a link to a third party website or service, a third party may also transmit cookies to you. Again, this Privacy Policy does not cover the use of cookies by any third parties, and we aren’t responsible for their privacy policies and practices. Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Services, and those third parties may not honor “Do Not Track” requests you have set using your browser or device.

 

Third Party App Information: When you download and install applications from a third party, or when you permit such third party applications to be updated, we may record information about the source, including the name of the app store or app market, its IP address, the application version number, or any unique application identification number associated with them.

 

Geo-location Information: When you use a location-enabled app and if you have opted in for the app to access your location, we may collect, process and retain information about your actual location. We may use geo-location information to the greatest extent permitted by law. We may also use various technologies to determine location, such as sensor data from your device that may, for example, provide information on nearby Wi-Fi access points and cell towers. The location data is collected anonymously in a form that does not personally identify you and is used by us to provide and improve location based products and services. By using a location-enabled app, you consent to us processing information about your actual location.

 

DO NOT TRACK POLICY

Through cookies we place on your browser or device, we may collect information about your online activity after you leave the websites of our Services. Just like any other usage information we collect, this information allows us to improve the Services and customize your online experience, and otherwise as described in this Privacy Policy. Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites.  Our Services do not support Do Not Track requests at this time.

 

INFORMATION SHARE

We do not rent or sell your Personal Information in personally identifiable form to anyone, provided certain Personal Information may be transferred in connection with business transfers, as described below. We may share your Personal Information with third parties as described in this section:

 

Information that’s no longer personally identifiable.  We may anonymize your Personal Information so that you are not individually identified, and provide anonymized information to our partners. We may also provide aggregate usage information to our partners (or allow partners to collect that information from you), who may use such information to understand how often and in what ways people use our Services, so that they, too, can provide you with an optimal online experience. However, we never disclose aggregate usage information to a partner in a manner that would identify you personally, as an individual.

 

To gain a better understanding of how our users use our Services, Redfinger may track user actions (such actions may include, without limitation, downloads completed successfully; installations completed successfully; Android apps installed successfully; Android apps started successfully; Android apps failed to start; and Android apps started but failed midstream) and record or report them over the Internet to a central analytics database. We use Google Analytics to grow our business, to improve or develop our products, to monitor and analyze use of our Services, for our technical administration, to increase the functionality and user-friendliness of our Services, and to verify that users have the authorization needed for us to process their requests. Advertisers: We allow advertisers and/or merchant partners (“Advertisers”) to choose the demographic information of users who will see their advertisements and/or promotional offers and you agree that we may provide any of the information we have collected from you in non-personally identifiable form to an Advertiser, in order for that Advertiser to select the appropriate audience for those advertisements and/or offers. For example, we might use the fact you are located in San Francisco to show you ads or offers for San Francisco businesses, but we will not tell such businesses who you are. Or, we might allow Advertisers to display their ads to users with similar usage patterns to yours, but we will not disclose usage information to Advertisers except in aggregate form, and not in a manner that would identify you personally. Note that if an advertiser asks us to show an ad to a certain audience or audience segment and you respond to that ad, the advertiser may conclude that you fit the description of the audience they were trying to reach.

 

Affiliated Businesses: In certain situations, businesses or third party websites we’re affiliated with may sell or provide products or services to you through or in connection with the Services (either alone or jointly with us). You can recognize when an affiliated business is associated with such a transaction or service, and we will share your Personal Information with that affiliated business only to the extent that it is related to such transaction or service concluded by you. One such service may include the ability for you to automatically transmit Third Party Account Information to your Services profile or to automatically transmit information in your Services profile to your third party account. We have no control over the policies and practices of third party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such business’ or websites’ policies.

 

User Profiles and Submissions: Certain user profile information, including your name, location, and any video or image content that such user has uploaded to the Services, may be displayed to other users to facilitate user interaction within the Services or address your request for our services. Please remember that any content you upload to your public user profile, along with any Personal Information or content that you voluntarily disclose online in a manner other users can view (on discussion boards, in messages and chat areas, etc.) becomes publicly available, and can be collected and used by anyone. Your user name may also be displayed to other users if and when you send messages or comments or upload images or videos through the Services and other users can contact you through messages and comments. Again, we do not control the policies and practices of any other third party site or service.

 

Business Transfers: We may choose to buy or sell assets, and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

 

Compliance with Laws; Protection of Redfinger and Others: To the fullest extent allowed by applicable law, we reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to (a) comply with law or court order; (b) enforce or apply our Terms of Use and other agreements; (c) or protect the rights, property, or safety of Redfinger, our employees, our users, or others; or (d) prevent fraud or abuse of Redfinger, our employees, our users, or others.

 

PERSONAL INFORMATION SECURITY

Your account is protected by a password for your privacy and security. If you access your account via a third party site or service, you may have additional or different sign-on protections via that third party site or service. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password and/or other sign-on mechanism appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account. If we receive instructions using your Redfinger account information we will consider that you have authorized the instructions.

 

We endeavor to protect the privacy of your account and other Personal Information we hold in our records. But unfortunately, no method of electronic transmission or storage is 100% secure, so we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

 

PERSONAL INFORMATION ACCESSBILITY

Please keep your information up to date and accurate. Through your account settings or by using features of our Services, you may access, and, in some cases, edit or delete the following information you’ve provided to us:

California Resident Rights

If you are a California resident, you have the rights set forth in this section. Please see the “Exercising Your Rights” section below for instructions regarding how to exercise these rights. Please note that we may process Personal Data of our customers’ end users or employees in connection with our provision of certain services to our customers. If we are processing your Personal Data as a service provider, you should contact the entity that collected your Personal Data in the first instance to address your rights with respect to such data.

 

If there are any conflicts between this section and any other provision of this Privacy Policy and you are a California resident, the portion that is more protective of Personal Data shall control to the extent of such conflict. INFORMATION SUBJECT RIGHTS UNDER TAIWAN PERSONAL DATA PROTECTION ACT

DELETION

You have the right to request that we delete the Personal Information that we have collected about you. Under the CCPA, this right is subject to certain exceptions: for example, we may need to retain your Personal Data to provide you with the Services or complete a transaction or other action you have requested. If your deletion request is subject to one of these exceptions, we may deny your deletion request.

 

RIGHTS EXERCISE

To exercise the rights described above, you or your Authorized Agent (defined below) must send us a request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected Personal Information, and (2) describes your request in sufficient detail to allow us to understand, evaluate and respond to it. Each request that meets both of these criteria will be considered a “Valid Request.” We may not respond to requests that do not meet these criteria. We will only use Personal Information provided in a Valid Request to verify your identity and complete your request. You do not need an account to submit a Valid Request.

 

Unless otherwise requested by applicable law, we will work to respond to your Valid Request within 45 days of receipt. We will not charge you a fee for making a Valid Request unless your Valid Request(s) is excessive, repetitive or manifestly unfounded. If we determine that your Valid Request warrants a fee, we will notify you of the fee and explain that decision before completing your request.

California Resident Rights

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Data to third parties for such third parties’ direct marketing purposes; in order to submit such a request, please contact us at [email protected].

 

Nevada Resident Rights

If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. You can exercise this right by contacting us at privacy at bluestacks.com with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your Personal Data as sales are defined in Nevada Revised Statutes Chapter 603A.
